Right of withdrawal

In short: you can withdraw from the contract within 14 days of concluding it, without giving a reason: by e-mail to office@smartbit.at, with the form below or through the Withdraw from subscription button. The subscription then ends immediately and we refund all payments. With the annual plan and its trial period, nothing has been paid within those 14 days.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (SmartbIT SG OG, Krakaudorf 115g, 8854 Krakau, Austria, e-mail office@smartbit.at) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at https://api.recsimple.com/konto-web/widerruf. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Start of the withdrawal period

The contract is concluded when you submit your order on the checkout page; the withdrawal period of fourteen days runs from that day. With the annual plan, the free 14-day trial period starts at that moment and the first payment does not fall due until it has ended. With the monthly plan, the first month is paid immediately.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

The subscription ends immediately upon withdrawal; we charge nothing for the time used until then.

Notes regarding RecSimple

The withdrawal concerns the subscription contract with us. The app remains installed on your device, and your recordings remain in your folder.
To declare the withdrawal, the e-mail address of your customer account and the date on which you took out the subscription are sufficient.
After the fourteen days you can cancel the subscription at any time with effect from the end of the paid term (clause 6 of the terms and conditions).
